A financial motive could possibly be
linked to the premature death of acting JudgePatrick Maqubela,
Judge John Murphy said in the Western Cape High Court on Monday.
"The prosecution believes accused one [wife Thandi Maqubela]
had a sinister motive and a use to obtain information about a life
policy," he said, reading from a long judgment document.
"There is merit in this submission... The death of the
deceased placed accused one in a position to inherit millions which she
otherwise would not have inherited had he died a few weeks earlier".
Maqubela and her co-accused Vela Mabena have pleaded not guilty to
suffocating her acting judge husband with cling-wrap in his Sea Point, Cape
Town, flat on 5 June 2009.
Maqubela has also pleaded not guilty to charges of fraud and
forgery regarding a document she alleges is her husband's last will.
Murphy said the judge took out a policy a few weeks before his
death and paid one premium of R17 000.
The policy paid out R20m to his estate upon his death.
